RG 48 The Last Will and Testament of Peter Webber

PP 346.347 In the Name of God Amen.
I, Peter Webber of Egmont Harbour in Jedore in the County of Halifax, Yeoman, being very sick and weak in Body but of perfect mind and memory, thanks be given to God, calling to mind the mortality of the Body and knowing that it is appointed for all men to die, do make and ordain this my last Will and Testament. That is to say Peacefully and first of all I give and recommend my soul into the Hand of the Almighty God that gave it, and I recommend my Body to the Earth, to be buried in decent Christian Burial at the discretion of my Executor, nothing doubting but at the general resurrection I shall receive the same again by the Almighty power of God. And as touching such worldly Estate wherewith that pleased God to bless me with in this life. I give desire and dispose of the same in the following manner and form.
First, I give and bequeath to Elizabeth, my dearly beloved wife, her maintenance from the property I now hold in Jedore and Clam Harbour as long as she may remain a Widow or unmarried in such ways and means as she may deem beneficial to herself with all my household Goods, debts and moveable effects, then of my sons within mentioned who remain single the longest and after while she remains a Widow are to share with her equal.
It is my intention that my daughter Elizabeth, whom it hath pleased the Almighty to inflict, is to have her maintenance from out of the real and personal estate above named and that her Mother take care of her as long as she may live and at her demise the son who remains single is to see her taken care of. And in case all the sons are married and she is not willing to stay with them, they are to allow her a comfortable maintenance in any way she may think proper while she remains unmarried. But in the event of her getting married she is to share the same as the others. Viz. Fifty acres of land, one good milch cow and three breeding sheep.
I also give and bequeath to my dearly beloved son Thomas 200 acres of land more or less situate lying and being on Ship Harbour Lake opposite the little Islands. But it is my intention if the Almighty spare my life to make an exchange of said land with my brother Philip, who now lives at Owls Head in the County aforesaid for one hundred and fifty acres of Marsh land which he now has adjoining. In case he does not make the exchange I wish the same to be purchased and given to my son Thomas as also fifty acres of mine adjoining it which will make him two hundred acres.
I also give and bequeath to my beloved daughters Mary Myers, Nancy Harper and Eliza Webber one hundred and fifty acres of land adjoining the land to the Westward of that I have bequeathed to my son Thomas, the same to be equally divided among them, share and share alike.
I also give and bequeath my beloved son William Webber my share of the Scallop Four Sisters, but it is my intention that my three sons James, Peter and William do eventually assist and help to maintain the Mother and Sisters.
I also give and bequeath to my beloved daughter Mary Myers the Cast Iron Stove and funnell which now stands in the house I occupy. I also give and bequeath to my daughter Eliza at her marriage a good milch cow and 3 breeding sheep. And it is also my wish and desire that whatever may be remaining of Real and personal estate after the decease of my beloved wife be equally divided, share and share alike.
I also appoint my Trusty and well beloved friend Colin Mitchell Junior of Egmont Harbour, Jedore to be my sole executor of this my last Will and Testament. And I do utterly revoke and desireth all and every other form, Testament, Wills and Legacies by me in any ??wise before names Wills and bequeathes, notifying and confirming no other to be my last Will and Testament. In witness whereof I have here unto set my hand and seal this Twentieth day of February in the year of our Lord one thousand eight hundred and thirty two.
Signed, Sealed, published and declared by the said Peter Webber as his last Will and Testament in his presence and in the presence of others have hereunto subscribed our names.
